(...)Este tema, escolhido pelas quatro Associações de Direito de Trabalho envolvidas nesta iniciativa, espelha bem as preocupações que nos unem, no quadro de uma crise económica que é global. É que, de facto, não só em Portugal, como noutros países europeus, a crise económica e as transformações sociais dos últimos anos têm posto à prova os quadros dogmáticos tradicionais do Direito do Trabalho de um modo tão profundo que obriga a equacionar senão o fim desta área jurídica pelo menos uma profunda viragem dos seus parâmetros axiológicos de referência.
O tema deste Congresso apela pois a uma reflexão sobre as príncipais áreas problemáticas do universo laboral neste contexto de crise: a negociação colectiva e os interlocutores laborais colectivos, procurando-se equacionar em especial o papel da lei, o tema dos direitos adquiridos, e os problemas da extensão de convenções colectivas e dos níveis de negociação colectiva nesta época (tema 1); o emprego e os modelos de contratação laboral, em especial na perspectiva de avaliar até que ponto os desenvolvimentos mais recentes nesta área põem em crise o paradigma tradicional do contrato de trabalho (tema 2); e, inevitavelmente, a flexibilização dos despedimentos em contexto de crise e os respectivos reflexos no princípio da protecção do posto de Trabalho (tema 3). Estes temas serão tratados, em cada uma das mesas, por eminentes prelectores provenientes de Universidades italianas, francesas, espanholas e portuguesas, com o objectivo de dar uma perspectiva comparada sobre o modo como os diversos problemas têm sido equacionados em cada país neste ambiente de crise económica global.
