(...) as principais razões para a publicação destes estudos - agora sob a forma de livro - residem no facto de, por um lado, os mesmos manterem atualidade, por outro, por se entender que se trata de textos com uma certa unidade concetual e que, por isso, melhor serão compreendidos com a sua reunião e, por fim, devido ao facto de o autor destas linha manter o interesse no tema, aliás, já manifestado na co-coordenação das anteriores obras: Arbitragem e Direito Público, Lisboa, AAFDL, 2015, reimpressão em 2018, e Arbitragem Administrativa em debate: Problemas gerais e Arbitragem em matéria de contratos públicos, Lisboa, AAFDL, 2018.
Deve ainda esclarecer-se que os estudos de arbitragem em causa são, na sua maioria, relativos a arbitragem de direito público. A razão para tal opção resulta do facto de se tratar de uma matéria que nos últimos anos tem merecido a atenção (continua) do legislador nacional.
Em traço muito grosso, os textos em referência debruçam-se em geral sobre alguns problemas e vicissitudes da arbitragem de direito público (administrativa e tributária), nomeadamente, sobre as várias "lacunas " que o(s) regime(s) da arbitragem administrativa ainda apresenta(m) e sobre a institucionalização da arbitragem de direito público.
De notar que um dos textos se refere ao tema (mais amplo, do ponto de vista dos meios) da resolução de litígios de direito administrativo em que a arbitragem administrativa surge como um (entre outros) dos meios para garantir a tão almejada resolução de litígios jurídico-administrativos em prazo razoável.
No contexto da procura de (outros) meios de (re)solução de litígios jurídico-administrativos irão ainda encontrar-se referências à mediação administrativa enquanto possível, futuro e desejado (?) meio de solução de litígios jurídico-administrativos.
Por fim, tendo em vista uma lógica de sistema de garantia de direitos - em que a arbitragem surge como uma forma de tutela primária de direitos -, inclui-se ainda um texto sobre responsabilidade civil do árbitro - que desenvolve o regime de tutela secundária de direitos - no caso de a arbitragem causar danos dignos de indemnização.
