Sumário executivo:

A presente dissertação teoriza a derrotabilidade normativa, aplicando-a aos conflitos entre normas da função administrativa. O recurso à teoria da derrotabilidade das normas visa apurar as condições, delimitando-as, em que o accionamento da previsão é insuficiente para que a estatuição se lhe siga. Sustenta-se que os efeitos de todas as normas podem, mediante determinadas condições, ser derrotados em função de outras normas. Trata-se de uma propriedade disposicional das normas, que existe em função de estas serem factual e normativamente contextualizadas.
Sendo a separação de poderes uma norma, daqui decorre, por consequência, que é derrotável. E é precisamente a compressão dos seus efeitos, em função dessa derrotabilidade, que justifica a existência de competências normativas no âmbito de uma função (tendencialmente) secundária do Estado, com propriedades semelhantes às funções (tendencialmente) primárias.
Ora, todas as normas regulamentares (mesmo as tradicionalmente caracterizadas como meramente executivas) acrescentam condições a normas hierarquicamente superiores. Ao fazê-lo, refinam as condições das normas superiores e têm, necessariamente, um efeito restritivo destas últimas ou do espectro linguístico dos seus enunciados. Nesta medida, compreende--se que operem no quadro de uma legalidade de compatibilidade e não de conformidade, sob pena de redundância normativa.
O ordenamento compreende normas gerais e especiais que resolvem conflitos entre outras normas, incluindo entre normas de conflitos. Estes conflitos podem ser resolúveis ou irresolúveis; no segundo caso, é necessário recorrer à ponderação como instrumento de sugestão do direito aplicável ao caso.
Todas estas hipóteses são testadas no ordenamento jurídico-administrativo português, caracterizado por uma pluralidade de centros de produção regulamentar dispersos pelos vários tipos de administração e pelo reduzido número de normas de conflitos. Neste contexto, aproveita-se para desmistificar duas asserções que pontificam na ciência jurídico-administrativa nacional: a inderrogabilidade singular dos regulamentos e o dogma de que a aplicação de normas de conflitos pela administração pública importa necessariamente uma fiscalização da validade da norma "desaplicada".
