Em versão mais curta, o presente trabalho teve publicação anterior em AA.VV., Estudos Comemorativos do 150° Aniversário do Tribunal da Boa-Hora, Lisboa: Ministério da Justiça, 1995,pp. 61-76.
Essa mesma versão, desta feita intitulada «Crítica à ideia de diminuição do risco de Roxin», foi também publicada na Revista Brasileira de Ciências Criminais, ano 4, n° 14 (Abril-Junho 1996), pp. 102-118.
Como já foi referido por ocasião da primeira publicação, estas páginas baseiam-se, é certo que remotamente, num trecho da minha dissertação de mestrado em ciências jurídicas (não publicada), intitulada Raciocínios hipotéticos e processos causais virtuais em direito penal, apresentada à Faculdade de Direito da Universidade de Lisboa em 31 de Dezembro de 1986 e sujeita a discussão em provas públicas em 30 de Novembro de 1987.
A legitimidade desta republicação advém de o texto contar agora com alguns desenvolvimentos significativos, para além de incorporar as possíveis actualizações bibliográficas.
No final, junta-se excertos da troca de correspondência científica com o Dr. Luís Greco, que enriquecem manifestamente a análise da problemática vertente. Aproveito para agradecer ao Dr. Luís Greco a autorização dada para a divulgação da referida correspondência.
