A presente Coletânea pretende ser, em primeira linha, um instrumento de apoio para os alunos dos cursos de mestrado e de pós-graduação da Faculdade de Direito da Universidade de Lisboa, nos quais são ministradas matérias de Direito da Água. Mas, além dessa finalidade mais didática, a Coletânea tem ainda como escopo auxiliar todos aqueles, juristas e não juristas, que na sua atividade profissional são chamados a aplicar diplomas de Direito da Água e que até agora não dispunham no panorama português de um tratamento organizado e sistematizado dos múltiplos textos legais, regulamentares e oriundos do Direito Internacional que regulam o setor da água.
A organização dos diversos textos normativos não se revelou propriamente uma tarefa fácil, uma vez que a vastidão de temáticas obrigou, em primeiro lugar, a um esforço de seleção dos diplomas fundamentais, sobretudo a propósito dos temas relacionados com os recursos hídricos, em que os regimes de proteção se encontram, por vezes, também previstos em diplomas aplicáveis à generalidade dos recursos naturais. Para não sobrecarregar uma compilação de textos já de si muito extensa, optou-se ainda pela não inclusão de diplomas complementares de regimes legais, a maioria deles mais técnicos e meramente regulamentadores da disciplina geral.
Reconhecendo a relevância do Direito Internacional da Água, são publicadas na Coletânea algumas das principais convenções internacionais sobre recursos hídricos (e.g. Convenção da Água e Convenção de Albufeira), mas a principal novidade reside na divulgação, pela primeira vez em língua portuguesa, da Resolução da Assembleia Geral da ONU n.°A/RES/64/292, de 28 de julho de 2010, que reconhece o direito humano à água potável e ao saneamento.As problemáticas atinentes aos serviços públicos de águas, outro subsetor do Direito da Água, não foram também descuradas, englobando-se os diplomas estruturantes da governação dos serviços, da proteção da qualidade da água para consumo humano e da defesa dos consumidores. O mesmo sucede com os regimes específicos aplicáveis às barragens e albufeiras, às águas minerais e de nascente, à contratação pública e ao regime económico-financeiro.
