RESUMO

O objetivo da presente dissertação é apurar se os escândalos que envolvem atletas e outras entidades desportivas são causa de perturbação da execução dos respetivos contratos de patrocínio e, em caso afirmativo, de que perturbação do contrato se trata.
Para responder a estas questões, começo por analisar o patrocínio enquanto realidade social e fenómeno comunicacional, para, de seguida, analisar o próprio contrato.
Concluo que alguns dos escândalos que envolvem os patrocinados resultam num efeito comunicacional de transferência de imagem negativa para os patrocinadores.
Sustento que, no âmbito da execução de um contrato de patrocínio, os escândalos que resultam num efeito de transferência de imagem negativa envolvem uma perturbação do cumprimento, a desconformidade contextual da prestação.
Sustento que o juízo de conformidade da prestação não recai apenas sobre as caraterísticas intrínsecas do objeto da prestação. O juízo de conformidade incide também sobre o objeto da prestação na sua relação com o meio envolvente, factual ou legal, o contexto do cumprimento.
A minha tese é que, nos escândalos do desporto que envolvem um patrocinado e resultam num efeito comunicacional de transferência de imagem negativa para o respetivo patrocinador, o conjunto de prestações comunicacionais do patrocinado, na sua relação com o contexto social e comunicacional de execução do contrato, se torna desconforme com o contrato, maxime, com o fim do contrato de valorização da imagem do patrocinador por apropriação das qualidades positivas da imagem do patrocinado.
Delimito esta perturbação do cumprimento afastando outras que, potencialmente, poderiam enquadrar o fenómeno: alteração das circunstâncias, impossibilidade superveniente da prestação ou do cumprimento, erro sobre o futuro, violação positiva do contrato e violação de deveres acessórios.
Termino identificando as soluções que a ordem jurídica oferece para a normalização das relações jurídicas afetadas. A resolução do contrato de patrocínio por justa causa apresenta- se como o remédio apropriado para travar a desconformidade contextual das prestações do patrocinado, sempre que a renegociação do contrato ou a cessação negociada se revelarem inviáveis. Por último, avalio os pressupostos de indemnização dos danos emergentes da desconformidade.
