Resumo

A presente tese reflete sobre o percurso histórico do ne bis in idem e sobre o atual âmbito de proteção da proibição constitucional de duplo julgamento e de dupla punição, à luz da proliferação e diversificação do poder punitivo público. Conclui-se que ainda é possível defender uma conceção ampla de ne bis in idem, aplicando-se a proibição constitucional a todas as manisfestações do poder punitivo público, de acordo com critérios de racionalidade argumentativa, proibindo-se, assim, a redundância da cumulação.
